August Chapter Meeting: FLSA Update by Jay Inman and LaToi Mayo, with Littler.
The Department of Labor (DOL) has now issued the final set of regulations that dramatically increases the thousands of employers are now facing number of employees eligible for overtime. Some reports estimate an additional five million employees will be eligible for overtime as a result of the rule. According to the DOL, these proposed changes to the Fair Labor Standards Act’s white-collar overtime exemption regulations will result in a $1.1 - $1.2 billion per year transfer of income from employers to employees. So how will this work in practice? Who is no longer exempt under the FLSA? Does the final rule now include a change to the “duties” test? Do entire sectors need to be reclassified? This special presentation prepared by Tammy McCutchen, a former DOL Wage and Hour Administrator, will be presented by LaToi Mayo and Jay Inman and will provide clarity on these thorny issues
