Legislative Update from BGSHRM Director Kelly Bolton

Just a note that the Governor issued new recommendations for Kentucky last evening that limits in person meetings (of any size) for all red counties – the majority of counties around Fayette call into that category, and Fayette itself is within a half percentage point of becoming red.


Please review Governor Beshear’s recommendations for red counties in Kentucky effective 10/26/20, which encourage all employers to allow employees to work remotely whenever possible.

  • Paycheck Protection Loan Forgiveness Program Details have been released and payroll providers have updated there systems with required reporting.  Employers are encouraged to follow up with their CPA prior to submission of any documents.
  • Ensure you are providing a hygiene kit for any employees who are traveling that includes gloves, a mask, tissues and hand sanitizer.
  • Ensure your facilities teams are taking precautions with the air ventilation in HVAC systems.

FFCRA – Families First Coronavirus Response Act:

DOL has issued guidance that employees who are laid off/furloughed are NOT eligible for paid sick leave or the FMLA expansion provision, since they are technically no longer employees.  Those employees who are still on the payroll are eligible for paid sick leave, and expanded FMLA provisions.  Please review HR6201.  Provisions of FFCRA apply to employers with 500 employees or less ONLY.

CARES – Coronavirus Aid, Relief & Economic Securities Act

Includes provisions of the Paycheck Protection Program funded by the SBA

OSHA – Has published guidelines for the reintegration of employees into the workspace.  You will want to ensure that you have face masks available for your employees.  Please review OSHA guidance on their website.
